Legal Rights of Kentucky Public School Teachers
Our firm has proudly represented the 5800 teachers in the Jefferson County School District and JCTA – the Jefferson County Teachers Association – for many years. JCTA’S collective bargaining relationship with the school board over 30 years has resulted in the best teacher compensation, benefits and protections of any school district in the Commonwealth. Our lawyers protect teacher rights by representing them in disputes over wages, discrimination, job assignments, unfair discipline, unfair evaluations, student assaults and the many issues that arise both in the classroom and in disputes with administrators. We also work closely with Association President Brent McKim and Executive Director DeeAnn Flaherty on issues involving legislative affairs, state regulation, election campaign compliance, priority schools and other policy issues influencing Kentucky educators.
JCTA membership includes the KEA Legal Services Plan, which pays the teacher’s legal fees for all qualifying cases. Through the Legal Services Plan, we represent teachers in all issues before their licensing agency, the Educational Professional Standards Board (EPSB), in grievances filed over unfair discipline, termination or denial of contract rights, in issues related to Child Protective Service (CPS) investigations or in complaints or legal actions brought by parents or students.
Our firm also represents teachers outside of Jefferson County in these same matters through the KEA Legal Services Plan.
We represent teachers who have been injured at work in securing their workers compensation benefits, as well as the special legal benefits for teachers injured through assault by students, or in managing misbehaving students. We also represent teachers in accidental injury cases, such as car accidents, slip and fall or other injuries occurring away from work.
